Tried but acquitted of charges of cowardice for his part in loss of the battle of Yellow Ford which was the worst defeat that has ever been suffered by the English in Ireland. He did not return to England but remained in Ireland some time and emigrated to Virginia Colony. He was a close personal friend of Bacon. This Montagu was the brother of Edward the 1st Baron of Montagu, and the son of Sir Edward Montagu of Boughton by his wife Elizabeth Harington.

Lady Elizabeth Seymour was born circa 1655. She was the daughter of Henry Seymour, Lord Beauchamp and Mary Capell. She married Thomas Bruce, 3rd Earl of Elgin, son of Robert Bruce, 2nd Earl of Elgin and Lady Diana Grey, on 31 August 1676. She was also reported to have been married on 30 October 1676. She died on 12 January 1696/97 at Tower of London, The City, London, England, in childbed, supposedly at alarm from her husband's danger. She was buried on 27 January 1696/97 at Maulden, Bedfordshire, England. On 28 June 1672 she was raised, by Royal warrant, to the precendecy of a daughter of a Duke. Her married name became Bruce. After her marriage, Lady Elizabeth Seymour was styled as Countess of Elgin on 20 October 1685.

The official biography of Montagu, commissioned by the legal heir of Charles Montague states:

"after the death of his wife in 1698, his Lordship took a Resolution of living single thence forward, and cast his Eye upon the Widow of one Colonel Barton, and the Neice to the famous Sir Isaac Newton, to be Super-intendant of his domestick Affairs. But as this Lady was young, beautiful, and gay, so those that were given to censure, pass'd a Judgement upon her which she no Ways merited, since she was a Woman of strict Honour and Virtue; and tho’ she might be agreeable to his Lordship in every Particular, that noble Peer's Complaisance to her, proceeded wholly from the great Esteem he had for her Wit and most exquisite Understanding, as will appear from what relates to her in his Will at the Close of these Memoirs."

There are two errors in this statement. First, is to name Barton as the widow of Colonel Barton who was in fact her brother and guardian of young Montagu; Second, to claim a platonic relationship between Barton and Montague. A later court case was filed on behalf of Montague Barton to claim heritage denied on grounds of perjury and conspiracy to deprive.
